Essentially the Party Wall Act 1996 only allows homeowners to do certain works to a party wall, after they have firstly notified adjoining owners, then either their written consent is obtained or ensure that a party wall Award has been prepared.

Before the commencement of project we wholly recommend you seek professional advice from a Party Wall Surveyor. If works are commenced without following the correct procedures there will be the possibility of long delays and increased associated costs or potentially an expensive litigation that could halt the project for years. If you have caused damage, almost certainly a hefty compensation order will be awarded to your neighbour.
The Party wall Act 1996 is designed to help all parties resolve any disputed about work on or near a party wall. It is a facilitative Act in that it allows the building owner to undertake works whilst protecting the legal rights of the adjoining neighbour.
The most important requirement of the Act is that a formal party wall Notice is served on your neighbour before any works are commenced, we cannot stress the importance of gaining professional opinion from a Surveyor to check if the Party wall Act applies to you.
